Ibinasura ng Quezon City Prosecutor’s Office ang reklamong estafa na isinampa ng GMA Network laban sa executives ng Television and Production Exponents (TAPE), Inc.
Kasama sa mga sinampahan ng reklamo ay sina Romeo Jalosjos Jr. (former president and CEO), Romeo Jalosjos Sr. (chairman of the board), Seth Frederick “Bullet” Jalosjos (treasurer), Michaela Magtoto (former senior vice-president for finance), Zenaida Buenavista (finance consultant), at Malou Choa-Fagar (former COO and CEO).
Inirekomenda ng prosekusyon na i-dismiss ang reklamo ng GMA-7 laban sa TAPE "for failure to establish prima facie evidence with reasonable certainty of conviction."

Nakakuha ang PEP Troika ng kopya ng huling pahina ng resolution.
Nakasaad dito ang hindi pagbayad ng TAPE sa GMA-7 ng PHP213,001,975.47 na pagkakautang.
PHP150,341,255.96 pa lamang ang naibibigay ng TAPE.
Bahagi ng nakasaad sa resolution: “Assuming it has the obligation to deliver the latter under the Assignment Agreement, then it was TAPE which violated said contract.”
DISMISSED DUE TO TECHNICALITY?
Sa aming pagkakaintindi, na-technical dito ang GMA-7.
Civil complaint lang dapat ang isinampa nila, hindi criminal complaint na estafa.
Collection lamang ito sa balanseng dapat bayaran ng TAPE.
Ang kumpanya ang may pagkukulang na dapat bayaran sa GMA, hindi ang executives na inireklamo ng stafa.
Sabi pa sa resolution: “In fact, in the demand letters of complainant to TAPE, [GMA Network legal counsel] knew and thereby admitted that it can only file a civil case for breach of contract and collection case in court against TAPE.”
Malinaw na civil liability ito ng kumpanya at hindi ng executives at stockholders na inireklamo.

Sinubaybayan ng PEP Troika ang isinampang complaint ng GMA-7 laban sa TAPE hanggang sa kanilang mediation.
Sinubukang makipag-negotiate ng TAPE kung paano nila mababayaran ang natitirang pagkakautang.
Pero hindi tinanggap ng GMA-7 ang terms ng settlement na inialok ng TAPE.
Sa mga nakaraang interview ng legal counsel ng TAPE na si Atty. Maggie Abraham, sinabi nitong ang TAPE ang nakipag-transact kahit sa pleadings pa lang kaya ang kumpanya ang may obligasyon sa pagbabayad.
Kinuha ng PEP Troika ang reaksiyon ng executives ng GMA-7.
Ayon kay GMA Network First Vice President for Legal Affairs Atty. Lynn Delfin: "We have not yet received a copy of the Prosecutor’s resolution. We will issue an official statement once we have reviewed the official document."
