Janet Lim-Napoles to remain at Fort Sto. Domingo jail after Makati RTC junks her petition for bail

“The evidence adduced by the prosecution is strong which leads this court to conclude that the offense of serious illegal detention, as charged, has been committed by Janet Lim-Napoles,” says the ruling by Makati Regional Trial Court on the Janet Lim-Napoles illegal detention case.


Ibinasura ng Makati Regional Trial Court ang inihaing Petition For Bail ni Janet Lim-Napoles (JLN), na nahaharap sa kasong illegal detention.

Ang kaso laban sa kanya ay isinampa ng kamag-anak at empleyado niyang si Benhur Luy.

Sa ulat ng GMA News website ngayong araw, November 21, nagbigay ng pahayag si Department of Justice (DOJ) Secretary Leila de Lima hinggil sa desisyon ng korte na hindi papayagang makapagpiyansa si Napoles.

“JLN’s petition for bail in the serious illegal detention case denied by Judge [Elmo] Alameda in an order issued today,” sabi ni Secretary de Lima.

Nakasaad din sa 15-page order, na inisyu ni Judge Alameda, na nakapagbigay ang DOJ ng matibay na ebidensiya na nagdidiin kay Napoles sa kasong illegal detention.

“The evidence adduced by the prosecution is strong which leads this court to conclude that the offense of serious illegal detention, as charged, has been committed by Janet Lim Napoles,” saad ng bahagi ng binasang ruling ng korte ngayong araw.

Matatandaang inireklamo ni Luy si Napoles at ang kapatid nitong si Reynald Jojo Lim, matapos siyang ikulong ng mga ito sa isang retreat house sa Magallanes Village, Makati City, mula December 2012 hanggang March 2013.

Si Napoles ang itinuturong utak sa likod ng 20 fake non-government organizations na tumanggap diumano ng sampung bilyong piso mula sa Priority Development Assistance Funds (PDAF) o mas kilala bilang pork barrel.

Si Luy ay empleyado ng JLN Corporation, ang kumpanyang pag-aari ni Napoles, na ginagamit diumano sa mga transakyong may kaugnayan sa kontrobersiyal na PDAF scam.



ILLEGAL DETENTION CASE AGAINST NAPOLES’S BROTHER. Kinumpirma rin ni Prosecutor General Claro Arellano ang tungkol sa desisyon ng korte kaugnay ng isinampang kaso ni Luy laban sa magkapatid na Napoles at Lim.

“The prosecution was also able to establish the existence of conspiracy between Janet Lim Napoles and [Reynald] Jojo Lim concerning the commission of the crime of serious illegal detention,” sabi ni Arellano.

Kahapon, November 20, nauna nang ibinasura ng Court of Appeals (CA) ang Motion for Reconsideration na isinumite ni Reynald Lim kaugnay ng pagkakadawit niya sa kasong illegal detention na isinampa ni Luy.

Bagamat pinanindigan ni Lim na walang sapat na ebidensiya laban sa kanya, hindi kinatigan ng CA ang kanyang petisyon na mapawalang-bisa ang arrest warrant na inisyu ng Makati Regional Trial Court.

“Injunction will not lie to enjoin a criminal prosecution because public interest requires that criminal acts be immediately investigated and prosecuted for the protection of the society.

“Wherefore petition is hereby denied. The challenged orders both dated August 14, 2013 of the Makati RTC Branch 150 are affirmed,” saad sa ruling ng Court of Appeals ukol dito.

PENDING PLUNDER CASE. Sa kasalukuyan, si Luy ay isa sa mga pangunahing whistleblower na sumailalim sa witness protection program ng Department of Justice.

Ayon kay Luy, kasabwat ni Napoles sa kontrobersiyal na pork-barrel scam sina Senators Juan Ponce-Enrile, Bong Revilla, at Jinggoy Estrada.

Sinasabing tumanggap si Senator Revilla ng P224.5 million, si Senator Enrile ng P172.8 million, at si Senator Estrada ng P183.79 million, bilang kickback diumano mula sa ghost projects ng pekeng NGOs ni Napoles.

Kaugnay nito, nahaharap ang tatlong senador sa kasong plunder, malversation, at graft na isinampa ng DOJ at National Bureau of Investigation sa Office of The Ombudsman, noong September 16.

Nagsampa rin ang Field Investigation Office (FIO) ng Office of The Ombudsman ng panibagong kasong plunder at graft laban kina Senators Enrile, Revilla, at Estrada, noong November 19.

Si Napoles naman ay nahaharap sa kasong plunder, malversation, at corruption of public officials, na isinampa ng DOJ at NBI sa Office of The Ombudsman noong September 16.

Sa ngayon, mananatiling nakakulong si Napoles sa Fort Sto. Domingo, sa Laguna, dahil sa kasong illegal detention case na isinampa ni Luy laban sa kanya.
