Mary Christine Jolly no show in preliminary investigation; still open to possible settlement with Derek Ramsay

In the preliminary investigation held earlier today, September 4, Mary Christine Jolly’s legal counsel maintains that Derek Ramsay’s camp hasn’t given any "offer of settlement" to date. Derek’s legal counsel, on the other hand, maintains there’s no need to offer any settlement because the actor "has not done anything wrong."


Hindi sumipot si Mary Christine Jolly sa itinakdang preliminary investigation sa Makati Prosecutor’s Office ngayong araw, September 4.

Tanging ang kanyang legal counsel na si Atty. Isaiah Asuncion ang humarap kay Assistant Prosecutor Erwin Dimayacyac, upang humingi ng extension para sa pagsumite ng reply affidavit ni Mary.

Kaugnay pa rin ito ng reklamong paglabag sa R.A. 9262 o Anti Violence Against Women and Their Children Act na inihain ni Mary Christine, 33, laban sa aktor na si Derek Ramsay, 37.

“Humingi lang kami ng additional time to finalize her reply affidavit,” sabi ni Atty. Asuncion sa panayam ng PEP.ph (Philippine Entertainment Portal) at ibang entertainment reporters kaninang umaga.

Ayon pa sa abugado, bukas si Mary na magkaayos sila ni Derek.

“There’s always a possibility. Pero sa ngayon, desidido naman siya [Mary] na ituloy yung kaso.

“In filing this case, she wants to attain justice, especially with the kid, especially with what happened.

“Kung magtuluy-tuloy yung kaso, siyempre mapa-file sa husgado.

“Yung judge na mismo ang magde-decide kung anong magiging consequence,” paliwanag pa ni Atty. Assuncion.

Nilinaw rin ng abugado na kasalukuyang nasa bansa ang kanyang kliyente.

PRELIMINARY INVESTIGATION. Ganunpaman, pinayagan ng prosecutor ang hiniling na extension ng kampo ni Mary upang maging patas sa magkabilang-kampo.

Nauna nang humiling ng extension noon ang kampo ni Derek para sa isinumite nitong counter-affidavit noong August 20.

Hindi naman tumutol ang legal counsel ni Derek na si Atty. Joji Alonso, na kasamang humarap sa preliminary investigation sa Makati Prosecutor’s Office kaninang umaga.

“If the complainant failed to submit the reply affidavit on the next scheduled hearing, the right to submit the same can be waived,” dagdag na pahayag ni Prosecutor Dimayacyac.

ON SETTLEMENT ISSUE. Tinanong ni Prosecutor Dimayacyac si Atty. Asuncion kung para saan ang “P45 million” advance lump sum na hinihingi ni Mary Christine.

Sagot ng abugado, pambayad umano ito sa gastusin ng 11-year-old son nina Derek at Mary “until college.”

Inengganyo ng prosecutor na mag-usap ang magkabilang-kampo para sa kapakanan ng bata.

Nang tanungin tungkol sa posibilidad na magkaroon ng settlement sa pagitan nina Derek at Mary, ito ang sagot ni Atty. Asunsion: “We have not received an offer of settlement.”

Buwelta naman ng legal counsel ni Derek na si Atty. Alonso: “We have nothing to offer because my client has not done anything wrong.”

Sa panayam ng 24 Oras kay Mary Christine noong August 29, iginiit ng Filipina-Indian na hindi “out of proportion” ang P45 million lump sum na hinihingi niya para sa “living expenses” ng anak nila ni Derek na kasalukuyang nakabase sa ibang bansa.

“It’s really an amount that is in proportion to the means of the child and in proportion to Derek’s capabilities as a father.

“It is not out of proportion. It is just the right amount towards his living expenses abroad,” sabi ni Mary Christine.

“LIMITED” MEDIA COVERAGE. Sa huli, pinaalalahan ng prosecutor ang magkabilang-kampo na iwasang pag-usapan ang merito ng kaso sa media “to avoid trial by publicity.”

Partikular na rito ang pangalan ng bata, pati na rin ang tirahan ng complainant at respondent.

“People has the right to know and to be informed. But we also have the right to protect the privacy of the child.

“Kawawa naman yung bata. Traumatic na nga yung nangyayari sa magulang niya. Huwag na natin dagdagan,” giit ni Dimayacyac.

Sa September 18 itinakda ang pagsumite ni Mary ng kanyang reply affidavit, habang sa September 25 naman itinakda ang pagsumite ni Derek ng rejoinder.

Hindi nabanggit kung kailan nakatakdang magharap muli sina Derek at Mary para sa isang closed-door meeting kasama si Dimayacyac.
