Comelec 1st division cancels Sen. Grace Poe’s COC for president

Sa ikalawang pagkakataon ay na-disqualify ang certificate of candidacy ni Sen. Grace Poe ng Comelec First Division. Nitong December 1, na-disqualify ng COC ni Poe ng Comelec Second Division.


Ibinasura ng Commission on Elections first division ang certificate of candidacy (COC) ni Sen. Grace Poe para sa pagkapangulo sa botong 2-1, nitong Biyernes, December 10.

Kabilang sa mga bumoto para sa petisyon na diskwalipikahin si Sen. Poe sina Commissioners Rowena Guanzon at Luie Tito Guia; samantalang hindi naman pumabor si Commissioner Christian Robert Lim.

Nag-ugat ang kaso mula sa petisyong isinumite nina dating senador Francisco Tatad, Prof. Antonio Contreras, at dating UP Law Dean Amado Valdez.

Sa 49-page decision ng Comelec first division, nakasaad na nakagawa si Poe ng material misrepresentation sa kanyang certificate of candidacy (COC) at "deliberately attempted to deceive and mislead the electorate" hinggil sa kanyang citizenship at residency qualifications, ayon sa ulat ng GMA News Online.

Pagpapatuloy pa ng first division tungkol kay Poe: "though a Filipino citizen, was not and could not have been a natural-born Filipino because she was adopted as a foundling with unknown biological parents."

Nakasaad din ito sa 1987 at 1935 Constitutions.

Pagpapatuloy pa ng Comelec first division: "Yet in complete disregard of what is clear under the law, the Constitution, and jurisprudence, Respondent declared in her COC for President that she is a natural-born Filipino citizen who is fully required to run and serve as President of the Philippines."

Nakagawa rin umano si Poe ng material misrepresentation na magiging residente na siya sa Pilipinas ng 10 taon at 11 buwan pagsapit ng botohan sa May 9, 2016.

Nakasaad din sa desisyon ng division na hindi ito kumbinsido na “honest mistake” ang nagawa ni Poe nang ideklara niyang anim na taon at anim na buwan sa kanyang COC for senator noong 2012.

"It is indeed incredible to think that Respondent (Poe), a well-educated woman and already then a public servant with full staff support, including a legal team, would not know how to correctly declare the facts material to her candidacy for the 13 May 2013 Elections."

Malinaw rin daw sa form na sinulatan ng senadora na "what was required to be stated therein is the period of residency up to the day of the elections."

Ayon pa sa division, mula October 2, 2012, ang petsang ibinigay ni Poe sa kanyang COC for senator ay “more or less” April 2006, na taliwas daw sa “respondent’s claim that she has been a resident of the Philippines since 24 May 2005.”


POE’S APPEAL. Samantala, agad namang naglabas ng official statement si Poe at sinabing hindi pinansin ng Comelec first division ang mga ebidensya niya, “just to deny me the chance to better serve our countrymen, and to also deny our people their choices in an open election."

Dagdag pa ni Poe, aapela siya sa Comelec en banc at sa Mataas na Hukuman.

Aniya, "We will appeal to the Comelec and the Supreme Court to uphold the truth, and the spirit and aims of our Constitution."

Sinabi naman ng legal counsel ni Sen. Poe na si Atty. George Garcia na hindi pa final ang desisyon ng first division at ito ay “subject to a motion for reconsideration.”

Dagdag niya, "Wala pa rin pong pagbabago, ganun pa rin po ang effect nito... kami po ay kandidato pa rin ... ang aming pangalan ay nasa listahan pa rin, hindi po magbabago ang lahat.

"Kami po ay magpa-file agad ng motion for reconsideration limang araw paglabas ng desisyon na ito."

Hindi ito ang unang beses na ikanansela ng Comelec ang COC ni Poe.

Nitong December 1, bumoto ang Comelec second division na kanselahin ang COC ni Poe, base sa petisyong isinumite ni Atty. Etrella Elamparo.

Nagkaisa ang tatlong commissioners ng second division sa desisyong ibasura ang COC ni Poe na sina Commissioners Al Parreño, Arthur Lim, at Sheriff Abas.
