Manila prosecutor junks Kris Aquino qualified theft complaint vs Nicko Falcis

Ibinasura ng Manila Prosecutor's Office ang reklamong qualified theft ni Kris Aquino kay Nicko Falcis dahil sa "lack of probable cause."

Si Nicko ay dating endorser closer, talent agent, at managing director ng pag-aaring digital company ni Kris—o mas kilala bilang Kris Cojuangco Aquino Productions (KCAP).

Lumabas ang resolusyong pirmado ni Manila Assistant City Prosecutor Geoffrey H. Llarena noon pang April 10, 2019.

Sabi rito, inireklamo ni Kris ang halagang PHP49,584 na diumano'y ginasta ni Nicko nang walang paalam gamit ang company credit card ng KCAP, sa mga establisimyentong sakop ng Manila.

Partikular daw rito ang halagang PHP36,624 na ibinayad ni Nicko para sa additional airfare charges sa isang airline company, noong July 12, 2018.

Pati na rin ang credit card transactions na may halagang PHP1,620 at PHP11,340 para sa airport terminal fees at business class upgrade ng isang plane ticket, noong July 24, 2018.

PROSECUTOR: NO QUALIFIED THEFT

Ayon sa prosecutor, malinaw na walang nangyaring qualified theft dahil nakapangalan kay Nicko ang gamit nitong credit card para sa mga gastusin ng KCAP.

Ang tanging accountability raw ni Nicko ay sa bangko na nag-isyu ng credit card.

"Given the foregoing, the use by respondent of the credit card for his personal expenses (even supposedly in violation of the personal agreement or arrangement between complainant and respondent) does not make him liable for qualified theft.

"He is only liable to pay the bank for the transactions he incurred using the credit card.

"Also, the fact that it is complainant who pays for the credit card does not affect the authority of respondent to make transactions using the same insofar as the bank is concerned and notwithstanding any private arrangement between parties or limitations of authority imposed by complainant for the use thereof."

NO ESTAFA AND CREDIT-CARD FRAUD

Sabi pa sa resolusyon, hindi rin nila mairerekomenda ang kasong estafa at credit-card fraud laban kay Nicko.

Ito ay dahil sa wala raw isinumiteng sapat na katibayan si Kris na may ginawang "misappropriation" ng kanyang pera si Nicko.

Bagkus, malinaw raw na ang mga binayaran ni Nicko, gamit ang KCAP credit card, ay mga transaksiyong hindi para sa personal na interes kundi may kaugnayan sa isang work-related trip.

Lalo pa't ang mga binayarang airfare charges ay para sa KCAP at personal staff ni Kris na lumipad sa Indonesia dahil may "commercial shoot" doon ang actress/TV host/web star.

"Having sufficiently explained these expenses, there can be no finding of estafa by means of unfaithfulness or abuse of confidence through misappropriation or conversion against respondent."

PROSECUTOR: NO INTENTION TO FLEE, DEFRAUD

Base pa rin sa desisyon ng Manila prosecutor, hindi nito kinatigan ang alegasyon ni Kris na nagtago si Nicko sa Thailand dahil may intensiyon umano ang KCAP managing director na lokohin ang aktres sa pera.

Kaugnay ito ng paglipad ni Nicko patungong Thailand noong September 26, 2018—o walong araw mula nang huling personal na nagkaharap sina Kris at Nicko.

"It must be stressed that prior to leaving, respondent issued a check in favor of complainant supposedly intended to answer for the transactions complainant disputes.

"Moreover, as respondent explained, he only went to Thailand upon the instruction of complainant to go there and enroll in a short course."

Dagdag pa ng Manila prosecutor, "Also there, being no proof or showing that the expenses incurred in Manila using the said credit card were made with intent to defraud, and intent to gain and fleeing thereafter, there can be no violation of RA8484."

Ang nabanggit na RA8484 ay tumutukoy sa batas na may probisyon para sa mga elementong maituturing na credit-card fraud.

STATUS OF #KRISAQUINOVSNICKOFALCIS LEGAL BATTLE

October 12, 2018 nang isampa ni Kris ang reklamong qualified theft laban kay Nicko sa Office of the Prosecutor ng pitong siyudad sa Metro Manila—kabilang ang Mandaluyong, Makati, Pasig, San Juan, Manila, Taguig, at Quezon City.

Noong February 2019, magkasunod na na-dismiss ang mga reklamong qualified theft na nakahain sa Office of the Prosecutor ng Makati at Pasig.

Noong April 2019, inatras naman ni Kris ang reklamong qualified theft na isinampa niya laban kay Nicko sa Mandaluyong at San Juan.

Sa Office of the Prosecutor ng Taguig, pending ang inirekomendang kasong estafa at credit card fraud laban kay Nicko.

Wala pa ring resolusyong ang nakabinbing civil case na isinampa ni Kris laban kay Nicko sa Quezon City.

Ayon sa sources ng PEP.ph, hanggang sa kasalukuyan ay sinusubukan ng magkabilang kampo na maayos na tapusin ang kanilang legal battle.
