Nakakadalawang panalo na si Nicko Falcis sa legal battle nila ni Kris Aquino.
Ito ay matapos ibasura ng Pasig City Prosecutor’s Office ang reklamong 44 counts of qualified theft na inihain ng actress/TV host/web star laban sa dating project director ng kumpanya niyang Kris Cojuangco Aquino Productions (KCAP).
"Insufficiency of evidence" ang ibinigay na dahilan kaya ibinasura ang reklamo ni Kris, 48, laban kay Nicko, 35.
October 2018 ay sinampahan ni Kris si Nicko ng 44 counts of qualified theft sa pitong siyudad sa Metro Manila, kasama ang Pasig, at mga siyudad ng Makati, San Juan, Mandaluyong, Taguig, Manila, at Quezon City.
Ito ay dahil sa ninakawan diumano siya ni Nicko ng P1.270 million sa pamamagitan ng paggamit ng company credit card.
Humihingi si Kris ng danyos na aabot ng P32.27 million.
Kabilang na rito ang P1,270,980.31 as actual damages, P15,000,000 as temperate damages, P1,000,000 as exemplary damages, P10,000,000 as moral damages, P5,000,000 as attorney's fees, at halaga ng pagtatagal ng bista o hearing.
THE DECISION
Sa 11-pahinang desisyon na pirmado ni Senior Assistant City Prosecutor Aileen C. Sabare, na inilabas noong February 15, 2019, nakasaad ang mga sumusunod:
“From the definition, it appears that the credit card used by respondent was neither stolen, revoked, cancelled, suspended, or obtained with intent to defraud.
“The credit card was voluntarily issued to respondent under his name.
“Thus, when the respondent used the credit card for purchases at Lucendi and Toby’s Estate in Pasig City, the credit card cannot be considered unauthorized within the tenets cited by law.
“WHEREFORE, it is resolved that the charges against respondent for Qualified theft and Violation of R.A. 8484 be DISMISSED FOR INSUFFICIENCY OF EVIDENCE.”
Aprubado ang resolusyon nina Rey Camilo B. Dumlao II, Reviewing Prosecutor, at Jacinto G. Ang, City Prosecutor.
Kung susuriin, mas nauna pa ang desisyon ng dismissal sa Pasig Prosecutor’s Office sa desisyon ng dismissal sa Makati Prosecutor’s Office noong February 18, 2019.
Ibinasura ng Makati Prosecutor’s Office ang reklamo ni Kris laban kay Nicko dahil din sa kawalan ng karampatang edibensiya.
Ang lima pang prosecutor's office na magbibigay ng kani-kaniyang desisyon ay mula sa mga siyudad ng San Juan, Mandaluyong, Taguig, Manila, at Quezon City.
