Duterte’s lead ICC lawyer seeks withdrawal from defense team

Dalawang miyembro ng defense counsel ni former Philippine President Rodrigo Duterte ang humiling na mag-withdraw mula sa defense team.

Ang isa sa kanila, inaprubahan na ng International Criminal Court (ICC).

Si Duterte ay nasa The Hague, Netherlands, para sa patuloy na pagdinig sa kasong crimes against humanity kaugnay ng kanyang war on drugs noong naging mayor siya ng Davao City hanggang sa maging Presidente ng Pilipinas.

Sa pinakahuling ulat, ang kanyang lead defense counsel na si Nicholas Kaufman, isang British-Israeli lawyer, ay humiling sa ICC na mag-withdraw mula sa team ni Duterte.

Sa redacted document na inilabas ng ICC, binanggit ang dahilan sa hiling niya mag-withdraw.

Sa pagbisita ni Kaufman kay Duterte noong Huwebes, May 7, 2026, nagdesisyon umano ang dating Pangulo na kumuha ng ibang abogado, ayon sa ulat ng GMA Integrated News.

"I am convinced that the continuity and efficacy of Mr. Duterte’s representation will remain assured through [REDACTED], who has a wealth of experience at the International Criminal Court, and the existing defense team.

Counsel thanks [REDACTED] for his extremely graceful, supportive and collegial approach," bahagi ng pahayag ni Kaufman sa Trial Chamber III, ang judicial body na nagha-handle sa kaso ni Duterte.

Hindi ibinunyag ang pangalan ng bagong lead counsel ni Duterte sa redacted document, subalit siya raw ay “he,” ayon naman sa Philippine Daily Inquirer.

Dagdag pa rito, nag-expire na raw ang isang taong kontrata ni Kaufman bilang abogado ni Duterte noong March 31, 2026.

ASSOCIATE LAWYER'S WITHDRAWAL APPROVED

Pinasalamatan naman ni Kaufman si Duterte at ang kanyang mga tagasuporta “who have shown their appreciation for my efforts on his behalf,” saad ng abogado sa hiwalay na pahayag.

Sunod na hihintayin ang approval ng ICC sa request for withdrawal ni Kaufman.

Itinalaga ang abogado bilang lead defense counsel ni Duterte nang dalhin ang huli sa The Hague sa bisa ng ICC warrant noong March 2025.

Sinabi rin ni Jacobs na ang kanyang pag-withdraw ay bunsod ng desisyon ng kampo ni Duterte na i-reorganize ang kanyang defense team.

ICC confirms 3 counts of crimes against humanity raps vs Duterte

Noong April 23, 2026, pormal nang kinumpirma ng Pre-Trial Chamber 1 ng ICC ang tatlong bilang ng kasong crimes against humanity laban kay Duterte.

Nakasaad ditong may sapat na basehan para makasuhan ang dating Pangulo.

Sa unang count ay ang “indirect co-perpetration, ordering and/or inducing, and aiding and abetting" na umano’y pagpaslang ng tinaguriang “Davao Death Squad” na 19 katao noong panahon ni Duterte bilang alkalde ng Davao City.

Ang pangalawang bilang ay ang “indirect co-perpetration, ordering and/or inducing, and aiding and abetting" na pagpaslang naman umano ng mga kapulisan sa 14 katao, na tinaguriang "High-Value Targets.”

Binanggit sa ICC document na noong panahon ng administrasyon ni Duterte, may mga tauhan umano sa Philippine National Police at Philippine Drug Enforcement Agency ang itinurong “perpetrators” sa ilan sa insidente ng pagpaslang.

Ang ikatlong bilang ay "indirect co-perpetration, ordering and/or inducing, and aiding and abetting" ng paspaslang at attempted murders ng may 45 katao.

Naganap umano ito sa isinagawang “barangay clearance operations” mula July 2016 hanggang September 2018 sa panahon ni Duterte.

Pagbibigay diin ng ICC, responsible umano si Duterte sa mga krimeng ito dahil ginawa niyang “state policy” ang sinasabing pag-“neutralize” sa mga taong masasangkot sa kanyang drug war at iba pang krimen.
