Negatibo ang naging reaksiyon ng publiko at ng netizens sa social media posts na ipinu-promote ang Captain’s Peak Garden and Resort na nasa Sagbayan, Bohol.
Nakatayo kasi ang resort sa mismong Chocolate Hills, ang sikat na tourist destination sa probinsiya.

Matapos umani ng batikos, inutusan ng Department of Environment and Natural Resources (DENR) ang Provincial Environment and Natural Resources Office (PENRO) sa Bohol na alamin kung ang Captain’s Peak Garden and Resort ay nabigong mag-comply sa inilabas na Temporary Closure Order (TCO) noong isang taon.
Sa official statement nito last March 13, 2024, sinabi ng DENR na nag-isyu si Regional Executive Director Paquito Melicor ng memorandum na nag-uutos kay PENRO Bohol Ariel Rica na alamin kung talagang nag-o-operate ang Captain’s Peak Garden and Resort.
Ayon sa ahensya, ang TCO para sa Captain’s Peak Resort ay inilabas noon pang September 6, 2023.
Nag-isyu rin ng Notice of Violation para sa mga proponent ng proyekto noong January 22, 2024 dahil sa pag-o-operate ng resort nang walang Environmental Compliance Certificate (ECC) mula sa DENR.
Ang anumang proyekto na itatayo sa Pilipinas na makakaapekto sa kapaligiran at kinakailangang kumuha ng ECC sa DENR-Environmental Management Bureau (EMB).

CHOCOLATE HILLS DEKLARADONG PROTECTED AREA
Sinabi ng DENR na ang Chocolate Hills sa Bohol ay idineklarang protected area sa pamamagitan ng Proclamation No. 1037 na inilabas ni former President Fidel V. Ramos noong July 1, 1997.
“This Proclamation designated the Chocolate Hills as a National Geological Monument and a Protected Landscape, recognizing the unique geological formations and the importance of covering this natural wonder for future generations,” ayon sa pahayag ng DENR.
“The declaration aimed to preserve the iconic landscape of the Chocolate Hills and promote sustainable tourism while protecting the biodiversity and environmental integrity of the area,” dagdag pa ng ahensya.
Ipinaliwanag din ng DENR na ang rights and interests ng landowners ay kikilalanin at igagalang kung ang lupa ay napatituluhan bago naideklarang protected area.
Gayunpaman, sinabi rin ng DENR na ang pagdedeklara sa isang lugar bilang protected area ay maaaring magpataw ng mga tiyak na restrictions and regulations kung paanong ang lupa ay maaaring gamitin at i-develop sa loob ng protected area, kahit pa ang mga lupang pribadong pag-aari.
Dagdag pa ng ahensya, ang restrictions and regulations na ito ay nakadetalye sa Environmental Impact Statement bago ilabas ang ECC para sa proyekto.

CHAIR NG SENATE COMMITTEE ON TOURISM, DISMAYADO
Nagpahayag naman si Senator Nancy Binay, chair ng Senate Committee on Tourism, ng pagkadismaya sa pangyayari.
Aniya sa inilabas na statement noong March 13, “Kung ang mga ahensya ng gobyerno na may tungkulin at responsibilidad na pangalagaan ang Chocolate Hills ay may pro-environment mindset, ang tanong po natin, bakit nakapagtayo ng resort at mayroon pang cottages and swimming pool?”
Nakatanggap din umano si Senator Binay ng report na inaprubahan ng Protected Area Management Board at nag-isyu ng resolusyon na “favorably endorsing” para sa development ng Captain’s Peak Garden and Resort noong 2022 at 2023.
Ayon sa senadora, “We understand the importance of development, but there should be boundaries.
“If the Department of Environment and Natural Resources continues to issue Environmental Compliance Certificate in the guise of 'tourism development,' I believe they have misunderstood what ecotourism is all about, and they have become complicit in defacing a natural monument they're supposed to oppose.”

Ang Bohol Island ay naging bahagi ng 195 global geoparks sa 48 bansa ng United Nations Educational, Scientific and Cultural Organization (UNESCO) sa pamamagitan ng isang resolution na na-adopt sa ginanap na conference sa Paris noong May 24, 2023
Nagsumite na si Senator Binay ng Senate Resolution No. 967 para imbestigahan ang pagkakaroon ng resort sa Chocolate Hills para mapangalagaan ang protected area and major tourist attraction ng Bohol.

RESORT DAPAT IPAGIBA
Nanawagan naman si Bohol Representative Alexie Tutor na ipagiba ang Captain’s Peak Resort.
"That Captain’s Peak Resort should not have been allowed to be built there in the first place,” ayon sa inilabas na statement ni Tutor.
Dagdag pa niya, “It should be demolished, and the construction site should be restored, with costs borne by the owners of that resort.
“But before these can happen, we have to follow due process."
Sinabi rin ni Tutor na suportado niya ang panawagan ni Bohol Province Board Member Atty. Jamie Aumentado Villamor, chairperson ng Provincial Board Committee on Environment and Natural Resources Protection, na ihinto na ang pagpapatayo ng mga istruktura sa paligid ng Chocolate Hills para maprotektahan ang major tourist attraction ng probinsiya.
“I agree with the Committee's findings and course of action. The Committee is correct in seeking the intervention of the Environment Secretary Maria Antonia Yulo-Loyzaga,” ani Tutor.

CAPTAIN’S PEAK RESORT HINDI ACCREDITED NG DOT
Sinabi naman ng Department of Tourism (DOT) na ang developments sa lugar na hindi tumutugma sa pagkakatalaga ng UNESCO sa Bohol bilang Global Geopark ay hindi dapat payagan.
Suportado rin ng DOT ang temporary closure ng Captain’s Peak Resort.
Sa inilabas na pahayag ng DOT last March 13, nilinaw ng ahensya na ang Captain’s Peak Resort ay hindi kabilang sa DOT-accredited tourism establishments.
August 2023 pa lang umano ay nagpahayag na ang DOT ng pangamba sa operasyon ng resort.
Ayon sa pahayag ng ahensya, “The Department of Tourism supports the preservation and protection of Bohol’s Chocolate Hills, located within a declared UNESCO Global Geopark and a source of national pride for the Philippines.
“[The DOT] agrees with the Bohol Provincial Government's position that development within the Chocolate Hills area are (sic) not consistent with its long-term sustainability, and should be disallowed.”
Binigyang-diin ng DOT na bagaman at ang development ay mahalaga para sa pagsulong at pag-unlad, kailangan itong isagawa, “in harmony with environmental and cultural preservation.”

CLAIM NG ADMINISTRATOR, RESORT SUMAILALIM SA TAMANG PROSESO
Ang may-ari ng Captain’s Peak Resort ay si Edgar Buton, isang kapitan ng barko.
Sa panayam ng The Freeman, isang Cebu-based media outlet noong 2023 kay Julieta Sablas, ang administrator at kapatid ng may-ari ng resort, sinabi niyang sumailalim ito sa tamang proseso para maipatayo.
Nagprisinta rin umano sila ng proposal sa PAMB ng DENR nang may mga gawing pagbabago sa inaprubahang plano kaugnay sa lokasyon ng ilang amenities ng resort.
