Kumalat online noong Agosto 31, 2024, Sabado, ang initial medico-legal report ng Philippine National Police (PNP) na nakapangalan kay Sandro Muhlach kaugnay sa insidente nito sa dalawang independent contractors ng GMA-7 na si Jojo Nones at Richard “Dode” Cruz.

Naka-box na pula ang findings: “General Survey: conscious, coherent, oriented to time, place and person.
“Physical Injuries: No external signs of application of any form of trauma.
“Ano-genital examination:
“Penis: Circumcised. No evident injury/ lesion noted at the time of examination.
“Scrotum: Both testes descended. No evident injury/ lesion noted at the time of examination.
“Anus: No evident injury noted at the time of examination.”
Ang CONCLUSION, “Medico-Legal evaluation shows no evident ano-genital injury at the time of examination but cannot totally exclude sexual abuse.
“Advised STI screening/panel. Advised counseling with psychiatrist/psychologist.”
Bahagi ng Remarks: “This initial Medico-Legal report is being issued for inquest purposes only.”
NONES-CRUZ CAMP CONFIRMS LEAKED MEDICO-LEGAL REPORT IS LEGIT
Marami ang nagtatanong sa legal counsel nina Nones at Cruz na si Atty. Maggie Abraham-Garduque tungkol sa medico-legal report na iyon.
Setyembre 1, Linggo, kinumpirma ni Atty. Maggie na ang kumalat na medico-legal report ay tunay.
Isa umano iyon sa mga ebidensiya ni Sandro na nakalakip sa complaint-affidavit na inihain sa DOJ laban sa mga kliyente niya.

Pahayag ni Atty. Maggie, “Katulad ng CCTV footages na nauna nang nailabas na ebidensiya ni Sandro na makikitang tuwid na tuwid itong maglakad at walang bahid ng nadroga or na-rape, this medico-legal report likewise does not support the rape case he filed against our clients.
“He filed a case for rape by sexual assault under paragraph 2 of the New Rape Law which is committed by any person who inserts his penis to the mouth or anal orifice of another or inserts any instrument or object inside the genitals or oral orifice of another.
“However, the medico-legal report shows no injury in the anus and wala rin namang allegation that a penis, object or instrument was inserted to Sandro’s mouth.”
CCTV FOOTAGE OF SANDRO MUHLACH
Ang pahayag ni Atty. Garduque tungkol sa CCTV footage ni Sandro ay taliwas sa interpretasyon ng behavioral science division ng National Bureau of Investigation (NBI) sa nakitang kilos ng baguhang aktor base sa CCTV footage.
Ayon sa agent on case na si Zulikha Marie Conales, "makikitang nagbago yung kanyang kilos" matapos ang insidente ng diumano'y pangmomolestiya kay Sandro.
Noong papunta pa lang siya sa hotel ng respondents ay "normal at relaxed ang movement ni Sandro."
Pero saad ni Conales, pagkatapos ng alleged incident ay "distressed at very anxious" na ang binata.
Ipinunto rin ng NBI agent na makikitang "balisa" si Sandro dahil sa bilis ng lakad at "bigla na lang siyang umupo sa tabi ng wall" sa tapat ng elevator.
Pagsusuma ni Agent Conales: "This is very consistent sa finding ng bureau na mayroong traumatic event na nangyari doon sa hotel kung saan naka-check in yung dalawang subjects na nirereklamo ni Sandro."

Setyembre 4, Miyerkules ng gabi, natanggap ng PEP Troika ang official statement ng legal counsel ni Sandro Muhlach na Puno Law Firm kaugnay sa kumalat na PNP Medico-Legal Report.
Pahayag ni Atty. Czarina Quintanilla-Raz ng Puno Law Firm: “We are appalled by the unlawful leakage on social media posts of the PNP Initial Medico-Legal Report of Sandro.
“The obvious attempt to give a false account of the incident by the perpetrators’ proxies shows gross ignorance of the law on how Rape through Sexual Assault is committed.
“We are gravely concerned by the unauthorized release of the Report and we intend to hold accountable those who participated in violating Sandro’s privacy.
“The palpable cruelty of their actions deserves just punishment given their knowledge of how Sandro continues to suffer from the trauma of what was done to him.
“Rape victims endure unimaginable pain. Every thoughtless action or careless word deepen their wounds.
“We ask everyone to show compassion and protect the dignity of Sando who has already suffered so much.
“We ask for your support by respecting Sandro’s privacy and ensuring that justice is pursued with the care and sensitivity that all rape victims deserve.”

Samantala, nagbigay rin ng pahayag si Atty. Maggie sa pagpa-file ni Sandro ng reklamo sa NBI sa online sites and accounts na nambu-bully umano rito.

Ani Atty. Maggie, “Actually my clients are bullied as well. They were called names, found guilty kahit wala pang nafa-file na kaso nun sa kanila.
“Sa isang FB page nga, nakalagay na pinatay or namatay na raw si Richard Cruz. Thus, they were advised to shy away from social media to protect their mental health.
“Yan kasi talaga ang risk when you publicize your story/allegations and evidence, naturally these will be subjected to public scrutiny.
“Hindi natin masisisi ang mga netizens to process and verify if your evidence supports your allegations.
“At siyempre may mga hindi aayon sa iyo. Kaya from the start we are firm that we will just give our version of the story and will just present our evidence in the proper forum.”
Nakatakdang magpasa ng counter-affidavit ang kampo nina Nones at Cruz sa Setyembre 12, Huwebes, sa DOJ, kung saan sasagutin at ipiprisinta nila ang mga kontra-ebidensya sa reklamong panghahalay na isinampa ni Sandro laban sa kanila.
