FDCP Chief Liza Diño appeals to showbiz industry to support Eddie Garcia Act

Nanawagan si Film Development Council of the Philippines (FDCP) Chairperson Liza Diño-Seguerra sa showbiz industry na suportahan ang isinusulong na Eddie Garcia Act, na magbibigay-proteksiyon sa mga manggagawa sa industriya.

Tinaguriang Eddie Garcia Act ang House Bill No. 0181, na inihain ni House Deputy Speaker Michael Romero, na layuning magsabatas ng Occupational Safety and Health Standards Act (OSHA) para sa pelikula, telebisyon, at teatro.

Inihain ni Congressman Romero, kinatawan ng 1-PACMAN Party-list, ang panukala kasunod ng aksidenteng pagkamatay ng 90-anyos na actor-director noong 2019.

Si Congressman Romero, 47, ay stepson ni Eddie.

Ina ng kongresista ang nabiyudang domestic partner ni Eddie na si Lilibeth Romero.

Sinimulan nitong January 28, 2020 ang pagdinig ng House committee on labor and employment sa panukala.

Sa hearing, iginiit ni Lilibeth na naaksidente at namatay si Eddie dahil sa “gross negligence, unsafe working environment, absence of an expert medic and crowd controller, no standby ambulance.”

Sa pagdinig noong nakaraang linggo, hiniling ni Lilibeth sa mga kongresista na gawing batayan ang aksidente ng movie icon sa pagpapasa ng batas na titiyak sa kaligtasan ng lahat ng manggagawa sa industriya.

EDDIE’S DEATH

June 8, 2019 nang natisod at nadapa si Eddie habang nagti-taping para sa teleserye ng GMA-7 na Rosang Agimat sa Tondo, Manila.

Nagkaroon ng neck fracture at na-comatose ang beteranong aktor.

Tuluyan siyang binawian ng buhay pagsapit ng June 20.

December 2019 nang natuklasan sa imbestigasyon ng Department of Labor and Employment-National Capital Region (DOLE-NCR) na nilabag ng GMA Network ang tatlong probisyon ng OSHS Law, na nagbunsod sa sakunang sinapit ni Eddie.

Ayon sa DOLE-NCR: 1) bigo ang network na mai-report sa DOLE, sa loob ng 24 oras, ang nangyaring aksidente, 2) walang safety officer sa set, at 3) walang first-aid responder sa location ng taping.

Dahil dito, pinagmulta ng DOLE ng P890,000 ang GMA-7 at anim pang pribadong kumpanya dahil sa nabanggit na mga paglabag.

Kaagad namang umapela ang pamunuan ng GMA-7 sa tanggapan ni DOLE Secretary Silvestre Bello III kaugnay ng pasya ng kagawaran.

FDCP HEAD ASKS FOR SUPPORT

Sa ikalawang pagdinig nitong Martes, February 4, humarap si Liza sa komite bilang FDCP head, kasama ang asawang si Ice Seguerra, at ang mga beteranong aktor na sina Bembol Roco at Rez Cortez.

Sumuporta rin sa grupo ni Liza, 36, ang premyadong aktres na si Batangas Representative Vilma Santos-Recto.

Bago pa magsimula ang hearing, idinaan ni Liza sa isang Facebook post ang “emotional” na pag-apela ng suporta para sa Eddie Garcia Act.

Post ni Liza: “I said to myself before; if there's only ONE thing na magagawa ko para sa industriya ng pelikulang Pilipino as head of FDCP, it would be to push for a law that would set standards on the working conditions of our workers—from working hours to occupational safety and health guidelines on the set, to social benefits, tenure and a minimum wage table for all sectors.

“Marami mang naumpisahang programs ang FDCP that address the many needs of our sectors, the lack of standards in the working conditions was still a glaring issue that we have been trying to address since 2017.”

Gayunman, aniya, tanging batas na aprubado ng Kongreso ang maaaring magtakda ng guidelines para sa mga manggagawa sa entertainment industry.

Ayon kay Liza, sa nakalipas na tatlong taon ay nagsagawa ang FDCP ng konsultasyon sa iba’t ibang sektor para mabuo ang “draft joint memorandum circular” na malapit nang maisapinal.

“For the last three years, we have been quietly but diligently doing the groundwork starting with the Film Workers Summit in 2017 and then conducting ten consultative meetings with the workers from various sectors—from the technical crew to creative and technical workers, directors, producers, and actors so that we can propose policies and guidelines to the Department of Labor and Employment on the working conditions and safety of our film workers in the audiovisual industry.

“This hard work and dedication gave birth to a draft joint memorandum circular already in its final stages to protect our workers.

“DOLE, in partnership with FDCP, will now have a POLICY to set standards and for the working condition of our workers as well as safety guidelines during production.”

A LAW TO BE NAMED AFTER EDDIE GARCIA

Pero ayon kay Liza, nabuhayan ng pag-asa ang industriya nang ihain ni Congressman Romero ang Eddie Garcia Act.

“Hindi pa rin ako makapaniwala,” bahagi pa rin ng post ng pinuno ng FDCP.

“Marami sa ating mga workers ang nawalan na ng pag-asa.

“We hear it during our consultations, and we felt their frustrations.

“Some would say, nag-aaksaya lang kami ng panahon, marami nang gumawa nito pero wala namang nagsucceed.

“But we never lost hope.

“Despite the challenges, we know in our hearts, we can find ways to make this happen.

“Basta magkaisa.”

PENDING BILLS

Kasunod nito, nagpasalamat ang pinuno ng FDCP sa mga mambabatas na naghain ng kani-kanilang bersiyon ng panukala upang mapabilis ang pagpapasa rito.

Bukod kay Congressman Romero, pinasalamatan din ni Liza sina 1-PACMAN Party-list Rep. Eric Pineda, TUCP Rep. Raymond Mendoza, Quezon City 2nd District Rep. Precious Hipolito Castelo, Camarines Sur 2nd District Rep. LRay Villafuerte Jr., ACT-CIS Rep. Nina Taduran, at Quezon City 5th District Rep. Alfred Vargas.

Bukod sa HB 0181 ni Congressman Romero, nakahain din sa Kamara ang iba pang mga katulad na panukala.

Ang HB 81 ang magtatakda ng mandatory occupational safety, health, and emergency response program para sa lahat ng gumaganap sa pelikula, telebisyon, at teatro.

Itatakda naman ng HBs 1019 at 5596 ang oras ng trabaho at iba pang terms of engagement sa pelikula, radyo, telebisyon, teatro, at iba pang media workers.

Titiyakin ng HB 1766 ang wastong working conditions sa industriya ng pelikula at telebisyon.

Paiigtingin ng HB 2476 ang proteksiyon, seguridad, at benepisyo sa mga miyembro ng media.

Tututukan naman ng HR 195 ang occupational health at safety ng mga nasa taping at shooting, kaugnay ng aksidenteng ikinasawi ni Eddie.

Apela ni Liza: “To the film industry, kailangan namin ng inyong suporta.

“In this industry na normal ang kanya-kanya, sana MAGSAMA-SAMA tayo.

“This is for all of us.

“For our future.

“For the next hundred years of Philippine Cinema.”
