NTC orders ABS-CBN to stop TV Plus, SKY Direct operations

In a statement, ABS-CBN management says that the alias cease and desist order against ABS-CBN TV Plus "means that viewers with TV Plus set-top boxes in Metro Manila will be unable to watch Teleradyo, Jeepney TV, Yey!, Asianovela Channel, CineMo, and KBO."

Alas-tres ng hapon ngayong Martes, June 30, natanggap ng pamunuan ng ABS-CBN ang alias cease and desist order (CDO) ng National Telecommunications Commission (NTC) laban sa ilang channels ng ABS-CBN TV Plus.

Bukod dito, may hiwalay ring cease and desist order laban sa SKY Direct, ang satellite cable service ng Sky Cable Corporation, kung saan napapanood ang cable channel ng ABS-CBN.

Base sa usapan nina Anthony Taberna, Jerry Baja, at ABS-CBN reporter Mike Navallo sa programang Dos Por Dos sa Teleradyo ngayong hapon, ang sakop ng alias CDO ng NTC ay ang ilang channels ng ABS-CBN TV Plus.

Kabilang sa mga ito ang Cinemo, Yey, DZMM Teleradyo, at KBO (Kapamilya Box Office).

Ang sakop ng alias CDO ay sa Metro Manila broadcast lamang.

Sa hearing ng Kongreso tungkol sa ABS-CBN franchise kahapon, June 29, iginiit ni NTC Commissioner Gamaliel Cordoba na kasama sa inihain nilang CDO laban sa network, noong May 5, na hindi maaaring mag-broadcast ang istasyon sa mga digital platforms nito.

Pero ayon kay ABS-CBN President and CEO Carlo Katigbak, hindi ito naging malinaw sa CDO ng NTC.

Kahit wala nang prangkisa ang ABS-CBN, napapanood pa rin ang ilan nilang programa sa pamamagitan ng ABS-CBN TV Plus o "ang mahiwagang black box."

Paliwanag pa ni Katigbak, ang gamit nilang frequency sa pagbu-broadcast ay sa sister company nilang AMCARA Broadcasting Network, kung saan mayroon daw silang long-term blocktime agreement.

Ang AMCARA Broadcasting Network ang naglalabas ng digital broadcast ng mga programa ng ABS-CBN sa pamamagitan ng Channel 43.

Pero ayon sa NTC, sa pagkawala ng prangkisa ng istasyon, hindi na maaaring magpatuloy ang mga programa ng ABS-CBN kahit ibang channel ang ginagamit nito upang makapag-broadcast.

Sa hearing kahapon, kinuwestiyon ito nina Anak Kalusugan Party-list Representative Mike Defensor at Cavite 7th District Representative Jesus Crispin “Boying” Remulla.

Dahil dito, nangako si Cordoba na maglalabas kaagad sila ng order upang ipatigil ang pagbu-broadcast ng Kapamilya programs sa ABS-CBN TV Plus.

THE NTC ORDER

Nakasaad sa alias CDO ng NTC na pagkatanggap ng ABS-CBN management ng order ay dapat tumigil na kaagad sila sa pagbu-broadcast sa digital TV transmission.

Saad sa kautusan na pirmado ni Cordoba at dalawa pang commissioners:

"IN VIEW THEREOF, upon receipt of this Order, ABS-CBN CORPORATION is directed to immediatley CEASE and DESIST from operationg digital TV Transmission in Metro Manila using Channel 43."

Inatasan din nito ang NTC National Capital Region na kaagad ipatupad ang kautusan.

SKY DIRECT

Sa isa pang cease and desist order, inatasan ng NTC ang cable company ng ABS-CBN na Sky Cable Corporation na agad itigil ang direct-to-home satellite transmission nila sa pamamagitan ng SKY Direct satellite dishes.

Napaso na raw kasi ang prangkisa ng SKY Direct noong May 4, 2020, kasabay ng pagkapaso ng prangkisa ng ABS-CBN.

Inatasan din nila ang kumpanyang magpaliwanag kung bakit hindi dapat bawiin ng gobyerno ang frequencies na assigned sa kanila.

Inutusan din ng NTC ang SKY Direct na magbigay ng refund sa subscribers na may mga load pang hindi nauubos sa kanilang satellite dishes.

Sa hearing sa Kongreso kahapon, hiniling ni Katigbak sa mga mambabatas ang patas na pagtrato sa kanila, katulad ng ibang broadcast companies na patuloy pa ring umeere kahit napaso na ang prangkisa.

Libu-libo raw mga empleyado nilang maaapektuhan kapag nawala sila sa ere.

Maaapektuhan din aniya ang milyun-milyon nilang mga manonood.

Pahayag ni Katigbak kahapon, “Between TV Plus and SKY, there are about 11 million homes that have access to our service.

"Pag pinutulan po natin 'yan, that's almost 55 million people that will lose access to their entertainment, their news and information.

"So sana po, ang appeal po namin sa Kongreso is, in the spirit of fairness, please consider that you have allowed other companies to operate before even after their franchises have expired for so long as Congress continues to hear their application for a renewal.”

Ngayong gabi, naglabas ng pahayag sa media ang ABS-CBN ukol sa alias cease and desist order ng NTC.

Iginiit ng pamunuan ng istasyon na hindi kasama sa naunang CDO ang Channel 43 ng AMCARA Broadcasting Network.

Dahil daw sa alias CDO, hindi na mapapanood ang ilang programa sa ABS-CBN TV Plus channels.

Umaasa rin silang mapagdesisyunan kaagad ng Supreme Court ang petisyon nila para sa temporary restraining order upang makabalik sila sa ere.

Narito ang kabuuang pahayag ng ABS-CBN:

"At 2:26 PM today, ABS-CBN received an alias cease and desist order from the National Telecommunications Commission (NTC) directing ABS-CBN to cease and desist from operating digital TV transmission in Metro Manila using channel 43.

"While channel 43 is not mentioned in NTC’s cease and desist order (CDO) of May 5, 2020, and it is ABS-CBN’s informed understanding that channel 43 is not included in the CDO, digital TV transmission in Metro Manila using channel 43 will cease tonight (June 30), consistent with the intent of the alias CDO.

"This means that viewers with TVPlus set-top boxes in Metro Manila will be unable to watch Teleradyo, Jeepney TV, Yey!, Asianovela Channel, CineMo, and KBO.

"ABS-CBN has a pending petition with the Supreme Court questioning the NTC’s CDO and hopes that such petition will be resolved soon in its favor so that it can resume broadcasting on both analog and digital platforms in the service of the Filipino."

skycable STATEMENT

Nagpadala rin agad sa media ng pahayag ang Sky Cable Corporation tungkol sa SKY Direct issue.

Ayon sa kanila, mawawalan ng access sa balita, impormasyon, at entertainment ang nasa 1.5 milyong subscribers ng SKY Direct.

Patuloy rin silang umaapela sa NTC na bigyan sila ng patas na laban katulad sa ibang kumpanya na napaso na ang prangkisa.

Narito ang buong pahayag ng Sky Cable:

"SKYdirect’s 1.5 million subscribers nationwide, including those in remote areas that do not receive television signals, will be deprived of access to the channels we carry that bring them news, information, education, and entertainment starting tonight June 30, 2020, as Sky Cable Corporation complies with the cease and desist order (CDO) issued by the National Telecommunications Commission (NTC) stopping the company from operating its direct broadcast satellite service immediately.

"In the spirit of fairness, we continue to appeal to the NTC to extend the same privilege given in the past to other companies whose franchises have expired but are currently pending in Congress to continue its operations until a resolution is passed.

"We assure our subscribers that we will exhaust all legal remedies to resume our services.

"We commit to attend to the concerns of our valued subscribers and partners arising from this decision.

"We will refund all unconsumed prepaid loads and advance postpaid payments.

"We appeal to our SKYdirect subscribers and partners for understanding and patience as we undergo this process."

Samantala, nagpapatuloy pa rin ngayon ang hearing ng ABS-CBN franchise sa Kongreso.
