Nagtatalo ang kalooban ni Carla Abellana sa usaping i-legalize ang divorce sa Pilipinas.

Paliwanag ng Kapuso actress, bilang konserbatibo, hindi niya masasabing pro-divorce siya.

Gayunpaman, aware siyang maraming Pilipino, lalo na ang mga galing sa failed relationships, ang nananawagang isabatas na ang divorce bill sa bansa.

Maging si Carla ay dumadaan sa divorce matapos mag-file ng divorce ang estranged husband niyang si Tom Rodriguez sa U.S.

Ikinasal sina Carla at Tom noong October 2021, pero naghiwalay pagsapit ng June 2022.

CARLA ABELLANA’S TAKE ON DIVORCE

Aware si Carla na tanging sa Pilipinas at Vatican na lamang ang walang batas ukol sa divorce.

Tinanong ng PEP.ph (Philippine Entertainment Portal) si Carla nitong June 21, 2024, sa press conference ng Widows’ War, ang upcoming primetime series na pagbibidahan nila ni Bea Alonzo, tungkol dito.

Pahayag niya: “It’s not new news, parang ilang beses na po na napag-usapan. Ilang beses na pong nag-attempt ang ating government, ang ating court na maipasa itong divorce bill.

“Vatican na lang at Pilipinas ang mukhang walang divorce, which shows anong society po, anong kultura meron tayo.

“Honestly, hindi ko alam… separation of state and church, but siguro they should listen more, yung ating public officials, they should listen to people, to the citizens kung ano ba talaga yung kailangan nila, gusto nila. Para dun sila mag-base.”

Pabor ba siya sa diborsiyo o hindi?

“Medyo mixed din,” sagot ni Carla.

“I wouldn’t say naman I’m pro-divorce, I wouldn’t say I’m anti-divorce.

“Parang ako din, medyo torn, given that I’m Roman Catholic.

"But ang napapansin ko at nararamdaman ko lang, personally, is ang dami nang sumisigaw na maipasa na siya, maging legal na siya.

"So, sana lang yon, mapakinggan na lalo na yung mga nangangailangan.”

CARLA on divorce issue with TOM

Noong January 29, 2024, iniulat ng PEP Troika na si Tom, isang Filipino-American, ay nag-file ng divorce sa U.S.

Nag-react dito si Carla at ipinaliwanag ang pagdadaanang proseso ng kaso lalo’t hindi pa legal ang diborsiyo sa Pilipinas.

Sabi ng aktres, magtatagal ang prosesong ito dahil kailangan umanong i-recognize ng local court ang divorce decree sakaling maaprubahan ang divorce case na isinumite ng aktor sa Amerika.

“Dito sa Pilipinas, ibang proseso po siya, e. Parang petition po siya, e. So, ongoing po yun,” paliwanag ni Carla.

“Kumbaga, yung ating local court, tatanggapin po nila yun. Kailangan po nilang i-recognize yung decree na yun, yung divorce decree.

“So, yun po ang parang gagawin na i-update yung status namin dito.

“Divorced po technically, pero dito po sa Philippines, in the process pa po yung pag-recognize po ng divorce decree.”

Nakasaad sa Philippine Consulate website kung ano ang divorce decree.

Ayon dito, “There is no divorce in the Philippines, but when a divorce is validly obtained abroad and initiated by the foreign spouse, the Filipino spouse shall have the capacity to remarry under Philippine law.”

Sa kasalukuyan, ang batas na kinikilala sa Pilipinas ay annulment.

Inilatag ang pagkakaiba ng divorce at annulment sa verywellmind.com.

Ang divorce ay “legal dissolving, termination, and ending of a legally valid marriage. A divorce ends a legal marriage and declares the spouses to be single again.”

Ang annulment naman ay court decision “that erases a marriage by declaring the marriage null and void and that the union was never legally valid."

Mananatili ang marriage records kahit na wala nang bisa ang kasal sa annulment.

“An annulment does not mean that the marriage never happened; it means that the marriage was never legally valid,” dagdag sa site.

Noong May 22, 2024, ipinasa ng House of Representatives ang Absolute Divorce Bill sa third and final reading nito. Aakyat na ito sa Senado para pagbotohan.

Nito lamang June 1, 2024, lumabas na 50 percent ng mga Pilipino ang sang-ayon na payagan ang divorce sa mga married couple na naghiwalay na at ayaw nang mag-reconcile.

Batay ito sa Social Weather Station poll na ginawa noong March 21-35, 2024.

Sa poll, 31 percent ang hindi sang-ayon sa divorce at 17 percent ang undecided.
