Nakatakda sa February 16, 2023 ang muling pagdinig sa kasong rape na isinampa ni Deniece Cornejo laban kay Vhong Navarro. Ito ang pinaghahandaan ngayon ng kampo ni Vhong.
Pero kamakailan lang ay naghain ang kampo ni Deniece ng motion for reconsideration with motion to inhibit sa Branch 69 ng Taguig Regional Trial Court.
Gusto nilang i-reverse ang bail grant kay Vhong at maglabas ng panibagong warrant of arrest laban sa comedian-TV host.
Nasa motion na isinumite na gusto nilang ipa-inhibit ang judge na may hawak ng kasong ito at ilipat sa ibang korte. Sa kanilang pananaw, biased o nagkamali ang korte sa desisyong payagang makapagpiyansa si Vhong.
Nakapaloob sa naturang motion na hindi raw nakapaghain ng ebidensiya sa takdang araw ang kampo ni Vhong kaya hindi raw dapat ito pinayagang makapag-bail.
Sabi naman ng isa sa legal counsel ni Vhong na si Atty. Maggie Abraham-Garduque sa UNTV News and Rescue, “We have proof naman that the defense was able to file formal offer of evidence.
“We were able to file the formal offer of evidence. At any rate, whether or not nakapag-submit ang defense is not material because in petition for bail, ang importante ay ang evidence ng prosecution.
“It is actually the prosecution which has the burden of proof to prove that the evidence of guilt of the accused in a rape case is strong.”
Naka-text din ng PEP Troika si Atty. Maggie at ipinaliwanag niya sa amin ang butas ng motion na isinumite ng kampo ni Deniece.
Saad niya, “Hinihintay pa namin ang action ng court with respect to this kasi walang notice of hearing na nakalagay sa motion.
“Under the rules kasi, a litigated motion like the motion for reconsideration, should have notice of hearing and conformity of the public prosecutor.
“Yung na-receive ko kasi na hard copy ng motion, walang notice of hearing and conformity ng Fiscal. Under the rules, this should be considered as a mere scrap of paper.”
Dagdag pang paliwanag sa amin ni Atty. Maggie, kapag ang isang criminal case ay People of the Philippines ang complainant, dapat lahat ng pleadings ng prosecution ay may pirma ng fiscal. Wala raw pirma ng fiscal ang kopyang natanggap nila.

Masalimuot ang usaping ito, at ipinauubaya natin sa husgado ang merits ng kaso. Basta, masaya tayo para kay Vhong na nakapiling ang pamilya nitong Kapaskuhan.
Samantala, noong Disyembre 28 na Feast of the Holy Innocents (Niños Inocentes), nag-post si Deniece sa Facebook ng isang 2022 message.

Na-monitor natin ang Holiday activities ni Vhong at mukhang sinulit niya ang family time nitong Kapaskuhan.
Nag-attend pa siya ng small Bible study group with Ogie Alcasid at mukhang naging mabunga at mabuti ito para kay Vhong.
Pagkatapos, nakaka-touch din ang ginagawang birthday celebration para sa kanya ng It’s Showtime family at may napaka-assuring message mula sa kanyang asawa.
Recharged at mukhang rested si Vhong nitong Christmas break. Sana lang, maayos at malampasan na niyang tuluyan itong mapanghamong parte ng kanyang buhay.
