DOLE says employers cannot force workers to use leave credits during quarantine

Hindi maaring pilitin ng employers ang kanilang regular employees na gamitin ang leave credits nila ngayong nasa ilalim ng enhanced community quarantine (ECQ) ang buong Luzon.

Ito ang iginiit ni Department of Labor and Employment Secretary Silvestre Bello III sa ginawang press briefing ng Inter-Agency Task Force for the Management of Emerging Infectious Diseases (IATF) kagabi, March 17.

Ayon sa DOLE secretary, “Yung leave credits mo, sa iyo 'yan.

“So, kung kailan mo gamitin, saka mo lang gagamitin.

“Noboby can force you to use it, if you don’t want to use it.”

Dagdag niya, “Ngayon, yung sinabi ko, yung about forced leave because of quarantine, pag pinilit ka ng employeer mo to undergo self-quarantine, at wala ka nang leave credits, ang mangyayari diyan, DOLE na ang mag-subsidize sa employer.

“Kami na ang magbabayad dun sa 14-day quarantine period mo.”

Dahil sa Luzon-wide enhanced community quarantine, sinabihan na ng gobyerno ang lahat na manatili sa bahay.

Kaya hindi rin daw mapipilit ng mga employer ang kanilang mga trabahante na pumasok sa trabaho.

Saad ni Labor Secretary Belo: “Actually, kung ayaw payagan ng mga employers ang manggagawa, puwedeng hindi pumasok ang manggagawa.

“They do not have to report if they don’t want to report, or since they’re under enhanced community quarantine, then they really cannot report.

“And they will be excused. There will be no basis for them to be disciplined.”

Sa mga kawaning pinipilit pa ring papasukin ng kanilang mga employer, maaari raw silang magsumbong sa DOLE.

Sabi ng labor secretary: “Saka kahit hindi sila magri-report, puwede nilang i-charge yung kanilang mga absents either sa leave credits kung meron pa.

“Kung wala, DOLE na ngayon ang mananagot sa kanila.”

Dagdag pa niya, titiyakin ng ahensiya na ang subsidy nito sa mga kumpanya ay makakarating sa kanilang mga manggagawa.

Aniya: “We will see to it that the employer will pay the employee kasi yun ay subsidy namin sa employees.

“Titiyakin namin na ang ibinibigay naming pera para sa manggagawa ay aabot sa kanya.”

May inilatag na ring emergency employment program ang DOLE para sa mga informal workers katulad ng sidewalk vendors, tricycle at pedicab drivers, at iba pa.
