Koko Pimentel cleared quarantine violation

On March 24, 2020, Pimentel went to Makati Med despite having COVID-19 symptoms.

Walang nilabag na quarantine rules si Senator Aquilino “Koko” Pimentel III.

Ito ang naging pagpapasya ng Department of Justice (DOJ) nang ibasura nito ang quarantine violation complaint laban sa 57-year-old lawmaker.

Ang reklamo ay kaugnay ng pagpunta ni Pimentel sa Makati Medical Center (MMC) noong March 24, 2020 para samahan ang manganganak niyang misis na si Kathryna Pimentel.

Iyon ay kahit na nang mga panahong iyon ay may mga iniinda nang sintomas ng COVID-19 ang senador, na sumalang sa swab testing.

Ilang oras pagkarating sa ospital, itinawag kay Pimentel ang resulta ng kanyang swab test: positibo siya sa virus.

Umani ng matinding galit ng publiko ang anila’y “iresponsableng” ginawa ng senador.

Humingi naman ng paumanhin si Pimentel.

Kasabay ng pagkondena ng MMC sa insidente, nabunyag na nagpunta rin si Pimentel sa S&R Supermarket sa Taguig City noong March 16.

Sa kasagsagan ng public outrage, kumilos si Atty. Rico Quicho, dating University of Makati Law dean, para kasuhan ang dating Senate President.

Naghain si Quicho sa DOJ ng reklamong paglabag sa Republic Act 11332 (Mandatory Reporting of Notifiable Diseases and Health Events of the Public Health Concern) laban kay Pimentel.

Ang reklamong iyon ni Quicho ang na-dismiss ng DOJ ngayong Huwebes, January 21.

GROUNDS FOR DISMISSAL

Batay sa 19-page resolution ng Office of the Prosecutor General (OPG) ng DOJ, ibinasura ang reklamo laban sa senador “for lack of probable cause.”

Si Assistant State Prosecutor Wendell Bendoval ang humawak sa reklamo ni Quicho laban kay Pimentel.

Sa resolusyon ni Bendoval, narito ang mga grounds for dismissal sa reklamo laban kay Pimentel:

1) Hindi “public health authority” si Pimentel kaya ang senador ay “not obliged to report under RA 11332.”

Para lang daw kasi sa public health authorities ang nabanggit na batas, saad sa resolusyon.

Ang tinutukoy na public health authorities ay ang Department of Health (DOH), ang Research Institute for Tropical Medicine (RITM), at ang Epidemiology Bureau.

2) Sinabi ni Bendoval na “there was nothing to report” nang magpunta ang senador sa S&R noong March 16 at sa MMC noong March 24.

“Senator Koko Pimentel only knew or learned about his condition of being positive for COVID-19 on the same day—24 March 2020, while he was already at the premises of the hospital,” saad sa resolusyon.

3) Pinasubalian ni Bendoval ang reklamong “non-cooperation” laban sa senador, alinsunod sa Section 9 ng RA 11332 “as Senator Koko Pimentel was deemed to have ‘cooperated’ when he left the hospital premises immediately after receiving the information about his medical condition.”

4) Mismong ang reklamong inihain ni Quicho ay “fatally defective.”

Hindi raw kasi si Quicho ang “proper party” para magsampa ng reklamo dahil wala naman ang abogado sa mga lugar na pinuntahan ni Pimentel.

Kaya naman ang mga ebidensiyang kalakip ng complaint ni Quicho ay “all hearsay as they were based only on news reports.”

Katwiran ni Bendoval, itinuturing na “hearsay evidence” ang news reports “because they were merely learned, read, or heard from others.”

NBI RECOMMENDS FOR CASE TO BE TERMINATED

Samantala, sinabi ni Atty. Honey Delgado, tagapagsalita ng OPG-DOJ, na ikinonsidera rin ni Bendoval ang resulta ng hiwalay na imbestigasyong ginawa ng National Bureau of Investigation (NBI).

Sinabi ni Delgado sa media: "NBI submitted to the DOJ a final report recommending that the case be closed and terminated."

QUICHO: “BULAG, PIPI AT BINGI ANG DOJ”

Sa isang Facebook post ngayong Huwebes, tinawag ni Quicho na “bulag, pipi, at bingi” ang DOJ sa pagbasura sa reklamo niya laban kay Pimentel.

Ipinauubaya na lang daw niya sa “taumbayan” ang paghusga kung lumabag nga ba sa quarantine health protocols si Pimentel o hindi.

Post ni Quicho: “Got the news that DOJ let Sen Koko scot-free.

“Bulag, pipi at bingi ang DOJ.

“Taumbayan na ang huhusga.”

PIMENTEL: DECISION IS “UNASSAILABLE AND CORRECT”

Para naman kay Pimentel, “unassailable and correct” ang naging pasya ng DOJ.

Sa kanyang Viber message sa Senate reporters ngayong Huwebes ng hapon, binigyang-diin ng senador ang ilang punto sa desisyon ng OPG laban kay Quicho.

“That decision is unassailable and correct. Tama naman yan,” quoted ng Philippine Daily Inquirer sa pahayag ni Pimentel.

“The complainant criminally charged me for violation of non-penal DOH issuances which are not even addressed to me.

“How can something non-criminal all of a sudden become criminal when you are not even expected to be knowledgeable or an expert about their contents?”

Ipinagtataka rin daw ni Pimentel kung bakit si Quicho ang pinanggalingan ng akusasyon laban sa kanya.

Dagdag ni Pimentel: “The person who charged me was not even anywhere near me or the place of the incident.

“Kakapagtaka why he became all of a sudden the source of the allegations.”

Isang beteranong mambabatas, si Pimentel ang executive vice chairman ng PDP-Laban, ang political party ni Pangulong Rodrigo Duterte.
