Naglabas ng pahayag ang kampo ni Tony Labrusca kasunod ng pagpabor ng Makati City Prosecutor’s Office sa reklamong acts of lasciviousness ng isang female complainant laban sa aktor.
Noong November 11, unang inulat ng PEP.ph ang resolusyon ng piskalya na may "probable cause" sa inireklamong "lascivious conduct" ni Tony.
Nagpadala ng statement si Atty. Joji Alonso, legal counsel ni Tony, sa PEP.ph ngayong Lunes, November 15, 2021.
Tingin ni Atty. Alonso, ang desisyon ng Makati prosecutor "suffers from grievous error."
Pahayag niya: "The Makati Office of the City Prosecutor through Deputy City Prosecutor Henry M. Salazar approved the filing of an information for Acts of Lasciviousness against our client, Mr. Tony Labrusca.
"We believe that the said Resolution suffers from grievous error in having resolved the complaint based on [female complainant's] one-sided allegations and failing to recognize that her claims are incredulous and contrary to human experience."
Giit pa ni Atty. Alonso, ang mga alegasyon ng female complainant laban kay Toni ay wala umanong basehan. Idiin din niyang inosente ang kanyang kliyente.
"We firmly stand that other than [female complainant's] unfounded, assertions, there is utter lack of evidence to support her accusations against our client.
"We sustain that Mr. Labrusca is innocent, and we shall remain steadfast in vindicating his name," ani Atty. Alonso.
Dagdag niya, "To protect our client’s rights, we filed a Motion for Reconsideration questioning the credence of said ruling. Mr. Labrusca has posted bail, as well."
Ang isyu ay may kinalaman sa nangyaring salu-salo sa bahay ng jeweler na si Drake Dustin Ibay noong January 2021.
Sa testimonya ng female complainant, nakasaad na hinila pababa ni Tony ang strap ng damit ng complainant para ma-expose ang dibdib nito.
Hinila rin umano ni Tony ang female complainant sa beywang at inupo ito sa kandungan ng aktor.
MOTION FOR RECONSIDERATION FOR SLIGHT PHYSICAL INJURIES JUNKED
Sa kabilang banda, ibinasura ng Prosecutor’s Office ng Makati ang mosyon na inihain ni Dennis Ibay, kapatid ni Drake, sa reklamong slight physical injuries laban kay Tony.
Sa parehong salu-salo, sinakal umano ni Tony si Dennis dahil sa matinding kalasingan.
Ibinasura ng prosecutor’s office ang reklamo noong June 22, 2021 dahil lampas na ng time limit ng filing sa piskalya ang inihaing reklamo ni Dennis.
Sa bagong resolusyon, na pirmado ni City Prosecutor Dindo G. Venturanza, nabanggit ditong ibinasura ang motion for reconsideration dahil sa pagkabigo ng complainant na magbigay ng panibagong ebidensiya para baliktarin ang nauna nilang resolusyon.
Ang resolusyon ay may petsang September 20, 2021.
